Penalties For A First-Time DUI In Georgia

The statutory penalties for a first-time DUI offense for someone who is 21 years of age (blood alcohol content > .08) could be as follows:

  • A fine of up to $1,000.
  • Jail — 10 days to 12 months. All but 24 hours can be suspended, stayed or probated.
  • Your driver’s license will be suspended for one year. Provided that you complete a DUI training course and otherwise comply with the conditions of your sentence, you can get your license back after 120 days. During that 120-day period, you may be able to get a limited driving permit.
  • 40 hours of community service.
  • Completion of DUI school.
  • If you hold a commercial driver’s license, you will lose your CDL.
  • There are also statutory minimums that the law requires to be part of your sentence. We can assist you with navigating those penalties as well.
