While the estate planning process may offer a variety of tools to help you prepare for a multitude of scenarios in life, some of the topics involved could seem difficult to address. Losing a loved one can be stressful as is, but preparing to protect his or her wishes while managing the affairs of the estate may also seem an intimidating concept.

What to expect 

Studies indicate that there may be various stages involved with the probate process in Georgia. A brief list of examples of what to expect after filing an official notice with the court may include: 

  • Validating a will:  One of the first steps involved with probate might pertain to authenticating the will, and the court may consider various topics before accepting a will as a valid document. 
  • Estate executor:  The executor of the estate may bear the responsibility of inventorying and obtaining appraisals of estate assets, as well as presenting a strategy for managing estate affairs to the court for approval. 
  • Creditor claims:  Probate may also seek to settle any debts held by the estate by giving creditors time to step forward with claims. The estate executor may also be responsible for managing any estate tax fees involved. 
  • Asset distribution:  Once the court approves the plan for distribution, the executor may be able to proceed with dividing the remaining assets among beneficiaries as dictated by the wishes of the testator. 

The length of the probate process may also vary depending on the variables at play, and while such a process may only last a few months at times, more complex cases might take years to finalize.
