Why a “DIY” approach to divorce isn’t ideal

Taking a “do-it-yourself” (DIY) approach to divorce might seem appealing, especially for couples hoping to save time or money. However, in Georgia, divorce involves more than just filling out forms and signing papers. 

Family law is complex, and even in cases where both parties agree on most issues, going through the process without legal guidance can lead to costly mistakes, overlooked rights and long-term negative consequences.

What’s the big deal?

One of the biggest risks of DIY divorce is misunderstanding legal requirements. In Georgia, divorce law covers issues like property division, child custody, parenting time, child support and spousal support. Even if you and your spouse think you agree, it’s easy to make assumptions about what the law allows or what a court might approve. Without legal knowledge, you might unknowingly agree to terms that aren’t in your best interest—or worse, terms the court won’t accept.

Property division, in particular, can be tricky. Georgia follows equitable distribution, meaning assets are divided fairly but not necessarily equally in the event that couples can’t resolve their differences on their own. Custody and parenting arrangements are another area where professional guidance matters. Courts in Georgia base custody decisions on the best interests of the child in question. While parents may try to draft their own agreements, failing to consider school schedules, travel times, holidays or future conflicts can result in an unworkable plan. A poorly written parenting plan can lead to repeated court visits or emotional strain on one’s child.
