In Georgia, some estates may qualify for a faster and easier process called simplified probate. This process is worth exploring because it can save time and reduce costs for loved ones. 

To make sure your estate qualifies, you must understand the requirements and plan ahead.

What is simplified probate?

Simplified probate in Georgia is available for small estates when no formal administration is necessary. The court may allow heirs to divide the estate without full probate if there is no valid will and no debts remain. If there is a will, the court must determine that the estate does not need full administration. In both cases, all heirs must agree on how to divide the property.

How can you qualify for simplified probate?

To increase the chance that your estate qualifies, reduce the amount of property that passes through probate. This means using tools that transfer assets outside the probate process. These tools include joint ownership, payable-on-death accounts and life insurance policies with named beneficiaries. Retirement accounts with designated beneficiaries also pass outside probate.

Keeping debts low is another key step. Courts look at whether the estate must pay creditors before allowing simplified probate. If the estate owes no money, the court is more likely to approve the faster process. Pay off debts while alive and avoid adding new ones near the end of life.

Clear record-keeping also helps. Maintain updated lists of all assets, account titles and named beneficiaries. Inform heirs where to find these records. When all heirs understand the plan and agree on what to do, the court process becomes smoother.
