No, preliminary breath tests (PBTs) conducted at the roadside are completely voluntary under Georgia law. An officer uses this portable handheld device primarily as an investigative tool to establish probable cause for an arrest, and numerical results are inadmissible at trial to prove your exact blood alcohol content (BAC). Politely refusing the roadside PBT does not violate Georgia’s implied consent law or trigger an automatic license suspension. However, this preliminary field test is legally distinct from the official, state-administered chemical test requested after a formal arrest occurs.
Will pleading “Nolo Contendere” (no contest) protect my driver’s license?
No, pleading nolo contendere will not shield your driving privileges from an administrative or criminal DUI license suspension. The Georgia Department of Driver Services treats a nolo plea to a DUI charge identically to a guilty plea or criminal conviction. While a nolo plea may occasionally avoid license points for standard traffic infractions, it provides no special protection against statutory license revocation for drunk driving offenses. You will still face mandatory driver’s license suspensions, reinstatement fees, probation and statutory requirements such as DUI alcohol risk reduction programs.
What is the difference between a “DUI Per Se” and a “DUI Less Safe” charge in Georgia?
A DUI Per Se charge is based entirely on chemical test results demonstrating a BAC of .08% or higher while operating a vehicle. In contrast, a DUI Less Safe charge allows prosecutors to seek a conviction without proving a specific BAC or when state-administered chemical testing was refused. To secure a Less Safe conviction, the state must prove that alcohol or drug consumption rendered you less safe to drive at that specific moment.
